IHC orders CDA to de-seal KP House

Counsel says lease of house expired in 2014 and there were also some dues.

ISLAMABAD: Islamabad High Court on Thursday directed the Capital Development Authority to de-seal the Khyber Pakthunkhwa House in the Red Zone of capital city.

The court issued the order to the civic agency on a petition file by government of Khyber Pakthunkhwa.

The federal government through the CDA sealed the JP House after an operation was conducted by law enforcement agencies when the chief minister of Khyber Pakthunkhwa Ali Amin Gandapur reached there during the protest of the PTI on Saturday.

When Chief Justice of the high court Justice Aamir Farooq took up the petition, the counsel for the CDA contended that the lease of the house had expired in 2014 and their were also some dues to be paid to the CDA.

However, the judge said that the sealing if the house belonging to a province without fulfilling the legal requirements was not only against the law but also shameful. The court said that before sealing the house the CDA should have issued a notice to the provincial government.

The judge remarked that the illegal action cannot he justified. He said that he was issuing orders to immediately de-seal the ptemises.
