Kulbhushan Case: IHC give 3 weeks duration to seek direction from Indian High Commission

 

ISLAMABAD: The Islamabad High Court (IHC) has given three weeks to the counsel for the Indian High Commission (IHC) to take instructions in the Kulbhushan Yadav case. Chief Justice Athar Minallah said that the decision of the International Court of Justice would be implemented in any case.

A larger bench headed by Chief Justice Athar Minallah and comprising Justice Amir Farooq and Justice Mian Gul Hassan Aurangzeb heard petitions from the Federal Ministry of Law and the Indian High Commission.

Chief Justice Athar Minallah asked what is the position of India in the Kalbhushan case?

On which the lawyer of the Indian High Commission said that the meetings of the Foreign Ministry are underway in Delhi. In any case, the decision of the International Court of Justice will be followed in the Kulbhushan case.

However, Attorney General said that Pakistan are ready to grant third consular access to India to Kulbhushan Yadav. The High Commission counsel said that the Deputy High Commissioner of India, Mr. Gorf, wants to appear before the court.

On which the lawyer said that the Deputy High Commissioner wanted to appear before the court and inform the court about taking the services of a lawyer.

Attorney General Khalid Javed Khan objected to the Indian Deputy High Commissioner appearing before the court without a lawyer, saying that Pakistan has repeatedly offered third consular access, India should first appoint a lawyer and the lawyer should appear before the court and an official The Chief Justice said that the decision of the International Court of Justice must be implemented.

The Attorney General said that at the next hearing, the court should be told whether India wants to hire a lawyer or not. He asked the attorney general to release the detainee if there were no restrictions, to which the attorney general said the crime was related to the Official Secrets Act and the matter needed to be looked into further.

At the next hearing, the court will also be informed about this. The Chief Justice told the Indian High Commission counsel that this is a positive development.

Barrister Shah Nawaz Noon said that India should reach a decision on legal aid to Kulbhushan. Given 3 weeks, do you have to follow Clubbhushan or not? India needs more time, the court granted the Indian High Commission’s lawyer’s request for more time and adjourned the hearing till January 14.
