ISLAMABAD: The Federal Constitutional Court has issued its first ruling, suspending a decision by the Peshawar High Court following an appeal from the Khyber Pakhtunkhwa (KP) government.
A two-judge bench, led by Justice Hassan Rizvi, heard the KP government’s appeal, which challenged the High Court’s ruling on employer obligations and worker rights. During the hearing, Justice Rizvi noted that poor workers cannot afford large security deposits.
Additional Advocate General Shah Faisal emphasized that the case concerns workers’ rights. He explained that if private employers fail to pay dues after terminating employment, workers can appeal to the relevant department, and any owed amounts can be secured through legal channels.
He argued that the Peshawar High Court had wrongly removed the requirement for employers to provide a security deposit, prompting the Federal Constitutional Court to suspend that ruling and issue a stay order. Notices were issued to the involved parties.
Earlier, the Federal Constitutional Court held its first hearing in Islamabad High Court, Courtroom 2. Chief Justice Aminuddin Khan has formed three benches for the court.
