FCC Says Jurisdiction of High Courts Is Limited

ISLAMABAD: The Federal Constitutional Court has set aside a decision of the Sindh High Court, ruling that the jurisdiction of high courts is limited under the Constitution and that decisions must be made strictly in accordance with the law rather than on emotional grounds.

The constitutional court nullified the Sindh High Court’s order that had allowed a student to appear in a special/super supplementary examination.

The court clarified that there is no provision in the law, rules, or regulations permitting special or super supplementary examinations. Therefore, high courts cannot issue such directions based on sympathy, equality, or personal sentiments.

The Federal Constitutional Court observed that sympathy or moral considerations cannot replace the law. It emphasized that judges must decide cases on the basis of justice and legal principles, not emotions.

The court further held that courts cannot apply personal moral standards or sympathetic considerations in place of the law.
