Five judges of IHC moves Supreme Court against acting CJ

ISLAMABAD: Five judges of Islamabad High Court have filed a petition in the Supreme Court on the issue of seniority and seeking direction for their acting chief justice to stop work.

The petition of the five Islamabad High Court judges was filed in the apex court by their counsel Munir A. Malik and Barrister Salahuddin under Article 184 of the Constitution.

The petitioners are Justice Tariq Mehmood Jahangiri, Justice Babar Sattar, Justice Mohsin Akhtar Kayani, Justice Saman Rifat Imtiaz and Justice Ijaz Ishaq.

According to the petition, the President cannot transfer judges from one High Court to another without public interest, and Justice Sarfraz Dogar should be barred from acting as the Chief Justice of the Islamabad High Court.

The petition has also stated that Justice Khalid Soomro and Justice Muhammad Asif be restrained from judicial work.

The judges of the Islamabad High Court have also made the President of Pakistan, the Federal and Judicial Commission, as well as the registrar of the Supreme Court, Sindh, Balochistan and Lahore High Courts as respondents to the petition.

It may be mentioned here that Justice Dogar was recently transferred to Islamabad High Court and made its acting chief justice in place its incumbent CJ who was elevated to the Supreme Court of Pakistan.
