IHC rejects FIA’s request for in-camera hearing of Imran’s bail plea

Chief justice says hearing will be held in open court on October 9th.

ISLAMABAD: The Islamabad High Court on Wednesday ruled that the hearing of the bail application if jailed PTI chairman and former prime minister Imran Khan in the cipher case will be conducted in an open court.

The chief justice of the high court Justice Aamir Farooq issued the verdict, which he had reserved in October 2, on a petition filed by the Federal Investigation Agency.

The FIA had contended that the trial of the cipher case was going on in-camera in the trial court, so the hearing of Imran’s petition seeking bail in the same case should also be held in camera.

The agency said they had to present some classified documents in the court so the hearing be held in camera.

The court however dismissed the FIA plea and observed that the hearing of the bail petition will be held in an open court on October 9th.

The chief justice added that during the hearing if the lawyers considered any documents as secrets these would be discussed in camera.

It may be noted that Imran was arrested on Aug 5th in the Toshakhana case and kept in the district jail of Attock. However, later, the high court suspended his three years sentence in the case.

He was however not released and kept in the jail in the cipher case and his judicial remand was extended. A week ago, Imran was shifted to the Adiala jail in Rawalpindi from Attock.

A day earlier, the law ministry issued a notification for continuing the trial of the case inside the Adiala jail.
