Reserved seats: Gandapur challenges oath-taking at Governor House

PESHAWAR: Khyber Pakhtunkhwa (KP) Chief Minister Ali Amin Gandapur and KP Assembly Speaker Babar Saleem Swati have filed a petition in the Peshawar High Court challenging the oath-taking of reserved seat members at the Governor House.

In the petition, the federal government, the Registrar of the Peshawar High Court, the KP Governor, the Election Commission, and others have been made respondents.

The petition states that when the assembly session began, the Speaker identified a lack of quorum and therefore adjourned the session. It emphasizes that the Speaker did not refuse to administer the oath but had postponed the session until July 24.

According to the petitioners, conducting the oath-taking ceremony at the Governor House is unconstitutional. They cite Article 65 of the Constitution, which requires that members of the assembly must take their oath within the assembly house.

The petition also mentions that while the Chief Justice, under Article 255(2), nominated the Governor to administer the oath, the petitioners were not given an opportunity to present their stance before this decision was made.

This legal move follows the oath-taking of 25 members elected on reserved seats, which took place on Sunday at the KP Governor House in accordance with a court order. The ceremony outside the assembly building has sparked a constitutional and political controversy.
