ISLAMABAD: The Islamabad High Court on Thursday remarked that agencies people could be put to trial if a citizen goes missing.
Justice Mohsin Akhtar Kayani passed the remark while taking up a case related to missing Baloch students.
During the last hearing of the case, the judge had warned that the court will order an FIR against the caretaker prime minister and the interior minister if missing Baloch students were not recovered by January 10.
The petition has been filed seeking the recovery of about 50 missing Baloch students.
Justice Kayani remarked that it was a simple case of human rights violation and shows that there is no law in the country.
As there was no progress on the recovery of the missing students, the judge said people go missing because security agencies do not follow law and respect courts. He said such disappearance of people would stop when the agencies are proceeded against in accordance with the law.
If any single person is missing, the prime minister, Interior ministry, defence ministry and other concerned authorities are responsible, he added.
He asked why no action was taken against any agency for getting citizens picked up and disappeared them.
He added that if a person was involved in any illegal case or in anti-state activities there are laws to take action against them.
The court asked if terrorists were proceeded against in accordance with the law, why Baloch suspects were picked up and made missing in persons instead of producing them in court.
The court adjourned further hearing till February 13 after directing the federal government to submit an affidavit that there would be no enforced disappearance of any citizen in future.
