ISLAMABAD: A petition has been filed in the Islamabad High Court challenging the National Highway Authority’s (NHA) decision to impose a 50 per cent additional toll on vehicles without an M-Tag and those with insufficient M-Tag balance.
The petition, filed by advocate Muhammad Jalal Haider, names the Ministry of Communications, the NHA and other relevant authorities as respondents. It seeks to have the policy declared unlawful and asks the court to order the refund of all penalties collected under the measure.
According to the petition, the NHA issued a notification on May 30, 2025, introducing the additional charge for non-M-Tag vehicles and vehicles with low M-Tag balances. It argues that the NHA Act authorises the collection of tolls but contains no provision allowing the authority to impose such penalties.
The petitioner contends that the policy violates constitutional provisions relating to due process, equality and property rights, and requests the court to declare the notification unconstitutional and void.
The petition also asks the court to direct the NHA to present the complete mechanism governing M-Tag balance management and its implementation.
