AJK Supreme Court Upholds Refugee Seats

MUZAFFARABAD: The Azad Jammu and Kashmir Supreme Court has reaffirmed the government’s authority over refugee seats in the Legislative Assembly and set clear limits on political protests during elections.

The ruling emphasizes that constitutional protections cannot be bypassed by administrative decisions or public agitation.

The court clarified that the twelve refugee seats are protected under Article 22, and any changes require a constitutional amendment under Article 33, preventing unilateral action. It supported the government’s stance that unresolved constitutional issues should be addressed by the elected Assembly, with amendments following proper procedures and public mandate.

While recognizing the right to peaceful protest, the court warned that road blockades, intimidation, and disruption of daily life are not constitutionally protected. “One individual’s rights cannot justify depriving others of theirs,” the judgment stated, reinforcing the administration’s duty to maintain order.

The court also stressed that elections must be held on schedule under Article 22(4), and political disputes cannot delay the process.
