ISLAMABAD: Chief Justice Islamabad High Court (IHC) Athar Minallah has issued a notice to Attorney General Khalid Javed Khan for assistance in the non-recovery of Imran Khan, who has been missing for five years. The Chief Justice said that if the Attorney General could not satisfy the court, he would impose fines on the Prime Minister and the cabinet.
However hearing a contempt of court petition in the case of recovery of Omar Abdullah, who has been missing for five years the court issued show cause notices to former secretary Zameer Hussain, former home secretary Arif Khan and former IG Islamabad Jan Mohammad.
During the eahring, Chief Justice Athar Minallah remarked that the JIT had said that there was a case of enforced disappearance but not against anyone. So responsibility has to be imposed, protection of citizens is the responsibility of the state, enforced disappearances are not tolerated in a society run under the constitution. If the federal government is responsible then why not fine the prime minister and the federal cabinet, the Chief Justice sought.
The Chief Justice of IHC remarked that enforced disappearance of any citizen is a heinous crime. If any citizen goes missing, the state is responsible for it. Chief Justice Athar Minallah asked the Deputy Attorney General not to say that the state should do anything. Not only security, but also the state must find out what is missing, even if it is picked up by the livestock owners, let’s find out where the missing person is.
Furthermore, Justice Mohsin Akhtar said that all the people should respond to the notices within 7 days and then they were told not to say no. He will be sent to jail for six months for showing incompetence. The court also issued notices to the present Home Secretary and Defense Secretary seeking report.
