Pakistan rejects India’s claims over occupied Kashmir

NEW YORK: Pakistan has said that India’s illegal annexation of Jammu and Kashmir will never be accepted by the occupied people of Jammu and Kashmir.

IIOJK was never, is not and shall never be part of India. It is a disputed territory, as is evidenced by all UN maps and official documents. 

Rabia Ijaz, Second Secretary at the Pakistan Mission, forcefully rejected the Indian claims in a right of reply (RoR) on the Report of the ICJ in the UN General Assembly.

The Pakistani delegate said that Security Council resolution 47 (1948), notes the desire of India and Pakistan that “the question of the accession of Jammu and Kashmir to India or Pakistan should be decided through the democratic method of a free and impartial plebiscite”.

She said that this call for a plebiscite was reiterated in Security Council resolutions 91 (1951) and 122 (1957), among others, and resolutions of the United Nations Commission on India and Pakistan, specifically its resolutions of 13 August 1948 and 5 January 1949. 

Rabia Ijaz reminded the Indian delegation that India accepted this decision and is bound to comply with it in accordance with Article 25 of the UN Charter. India can’t wish it away through legal acrobatics. 

She said that the ongoing occupation of Jammu and Kashmir by India remains a blatant violation of international law and a serious affront to the right of self-determination for the region’s people, as mandated by multiple United Nations Security Council (UNSC) resolutions.

India’s continuous military presence and repressive measures in the disputed territory transgress all accepted norms of legality and humanity, she said. 

Rabia Ijaz said that true respect for international law would require India to withdraw its forces from Jammu and Kashmir and uphold the UNSC resolutions that guarantee Kashmiris the right to decide their future. 

She asked the international community to urgently intervene to alleviate the suffering of the people of Jammu and Kashmir and facilitate a peaceful, democratic solution that honors their right to self-determination, as enshrined in the UN Charter.
