SC orders restoration of Hindu Samadhi in Karak and recovery of money from the accused
The Supreme Court of Pakistan has ordered to start the restoration work of the burnt Hindu Samadhi in Karak area of Khyber Pakhtunkhwa in two weeks and recover the money spent on it from other accused including Maulvi Sharif. Orders were also issued to stop encroachments on abandoned waqf properties and take action against the officials involved in the seizures.
A three-member bench headed by Chief Justice Gulzar Ahmed heard the suo motu notice case related to burning of Hindu Samadhi in Karak. At the beginning of the hearing, Justice Ijaz-ul-Ahsan remarked that the incident in Karak was very unfortunate. Destroyed and Samadhi was set on fire.
Chief Justice Gulzar Ahmed asked how the police allowed the mob to enter. The job of the police is to enforce the law, the government writ should be maintained, Advocate General Khyber Pakhtunkhwa took the position that Maulvi Sharif has been arrested, negligent police officers have been suspended and a case will be registered against them.
The Chief Justice said that the main accused Maulvi Sharif will be released on bail in a few days. What will happen with the suspension of police personnel, they will continue to receive their salaries. Where was the police intelligence before the incident? On the statement regarding the reinstatement of Samadhi, the Chief Justice said that the money for the restoration of Samadhi should be received from Maulvi Sharif and his gang, because when money is taken out of his pocket, he will realize.
The Chief Secretary said that the restoration of Samadhi would be done immediately at the government’s expense, but the money would be recovered from those responsible. Chairman Minority Commission Shoaib Suddle said that the area around Samadhi was in the custody of abandoned waqf properties. But he could not protect it. Like Kartapur, this place is sacred to Hindus. Maulvi Sharif is the real culprit in setting fire to Samadhi, hopefully he will not be granted bail soon.
Hindu Council Chairman Ramesh Kumar said that this Samadhi has two big festivals, about 400 people come to the Samadhi in a month. Maulvi Sharif had also broken the Samadhi in 1997. Despite the court order, the abandoned Waqf property restored the Samadhi. No, the Hindu Council restored Samadhi by paying Rs 4 crore. The chairman of an abandoned waqf property in Pakistan is not a Hindu but a Muslim.
On a judicial inquiry, the IG Khyber Pakhtunkhwa said that 12 officers on duty, including SP and DSP, have been suspended while 109 people involved in the incident have been arrested. Out of six clerics attending a gathering of Jamiat Ulema-e-Islam in the area, only Maulvi Sharif Provoked protests.
Criticizing the Chairman Abandoned Waqf Property Board, the Chief Justice said that the officers of the board are only making money, with which they take back the land and give it to whomever they like. Justice Ijaz-ul-Ahsan said that the Abandoned Waqf Property The Board co-operated with the Judicial Commission on the contempt notice.
The court directed to start the restoration work of the burnt Hindu Samadhi within two weeks and sought details of all the temples in the country from the Chairman Abandoned Waqf Property Board. The court said that the total number of temples and how many are active should be stated. The Abandoned Waqf Property Board has also ordered to submit details of land grabs and encroachments and pending cases within two weeks.
