ISLAMABAD: The Federal Constitutional Court (FCC) has ruled that only permanent employees are entitled to seniority, excluding contract employees from being counted in seniority lists.
Justice Hassan Azhar Rizvi issued a 20-page written verdict, overturning a previous decision by the Sindh High Court. The court stated that in the absence of clear laws, contract employees cannot be included in seniority rankings.
The court emphasized that contract employees cannot be treated as regular employees, and time served prior to regularization cannot be counted towards seniority in the regular cadre.
The judgment directs that contract employees have no right to seniority, which begins only upon formal regularization. The court also ordered the Sindh Employees Social Security Institution to recompile the seniority list.
According to the ruling, the revised seniority list must be completed within 60 days. Additionally, the court invalidated the previous seniority and regularization dates of Director Nadir Hussain.
