IHC Strikes Down Ban on Land Transactions in Islamabad

ISLAMABAD: The Islamabad High Court (IHC) has declared illegal an administrative ban on the sale, registration and transfer of land in Shah Allah Ditta, Sarai Kharbuza and Sangjani, ruling that it violated citizens’ constitutional property rights.

In a written judgment, Justice Muhammad Asif held that authorities cannot suspend property transactions under the pretext of curbing illegal housing schemes.

The court said the restriction, imposed on the basis of a Capital Development Authority (CDA) letter and administrative directions, had no legal basis.

The ruling stated that executive authorities cannot alter the scope of judicial orders through administrative instructions and must act strictly in accordance with the law.

While reaffirming the government’s authority to act against illegal housing schemes, the court directed officials to follow the prescribed legal procedure without infringing on the rights of law-abiding citizens.
